Who pays the estate agent's commission in Mallorca?
In Spain it is normally the seller who pays the commission, so for buyers the services of estate agents in Mallorca are usually free of charge. There is no statutory rate - the fee is agreed between seller and agency in the listing agreement and depends on the property, its location and the scope of the service. Sellers should have the terms in writing before instructing an agency, including exactly when the commission falls due.
Do estate agents in Mallorca need a licence?
Yes - since 9 November 2024 the Balearic housing law (Ley 3/2024) has required anyone acting commercially as an estate agent to be entered in the official register, the Registro Oficial de Agentes Inmobiliarios de las Illes Balears. Registration requires professional indemnity insurance of at least 100,000 euros per claim, a fixed business address and a visibly displayed registration number. Ask for that number before instructing anyone - in the rest of Spain the profession is largely unregulated, so the Balearics are stricter than the mainland.
Why is the same property listed by several agents in Mallorca?
Many sellers work with several agencies at once rather than granting an exclusive mandate, so the same house often appears with different prices and photos at different offices.
